1. Acceptance of Terms

Welcome to Team Summit Colorado (“Team Summit,” “we,” “our,” or “us”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “user”) and Team Summit Colorado, a 501(c)(3) nonprofit organization, governing your use of our website located at teamsummit.org (the “Website”) and all related services, programs, events, and activities (collectively, the “Services”).

By accessing or using our Website or Services in any manner, including but not limited to visiting or browsing the Website, registering for programs, participating in events, making donations, purchasing merchandise, or using our Parent Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use our Website or Services. If you are under 18 years of age, your parent or legal guardian must review and accept these Terms on your behalf before you may use our Services.

These Terms apply to all users of the Website and Services, including without limitation athletes, parents, guardians, volunteers, coaches, donors, and visitors. Team Summit reserves the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on the Website. Your continued use of the Website or Services following the posting of revised Terms constitutes your acceptance of such changes.

2. Description of Services

Team Summit Colorado is a youth development organization dedicated to empowering young athletes to realize and celebrate their personal podiums through comprehensive winter and summer sports programs. Our Services include but are not limited to:

Athletic Programs: We offer year-round training and development programs in multiple disciplines including Alpine Racing (Slalom, Giant Slalom, Super G, and Downhill), Snowboarding (Big Mountain, Park & Pipe, and Boardercross), Freeskiing (Big Mountain, Moguls, Park & Pipe, Ski Cross, and Skimo), Nordic skiing (Classic Ski & Skate Ski), Mountain Biking (XC & Enduro), and our Intro to Team Summit (ITS) program for beginners.

Educational Services: Through Team Summit Academy, we partner with high-achieving schools throughout our area to provide college-preparatory education for our full-time athletes, guiding student-athletes to excel both athletically and academically.

Event Management: We host and organize various competitions, training camps, fundraising events, and community outreach activities throughout the year, providing opportunities for athletes to compete in familiar environments while generating essential revenue for our programs.

Digital Services: Our Website provides access to program registration, event information, a Parent Portal for secure communication and account management, an online store for merchandise purchases, donation processing, volunteer coordination, and educational content through our blog and resource sections.

Community Outreach: We operate a Financial Assistance Program to make snowsports accessible to local youth who might not otherwise have the opportunity to participate, along with various community engagement initiatives that strengthen the bond between families and the mountain community.

All Services are provided in accordance with our mission to develop the next generation of skiers and snowboarders while fostering excellence, respect, integrity, responsibility, fun, and family values in a supportive and challenging environment.

3. User Eligibility and Registration

Age Requirements: Our athletic programs are primarily designed for youth athletes. Specific age requirements vary by program and are detailed in individual program descriptions. Participants under 18 years of age must have their registration completed and these Terms accepted by a parent or legal guardian who will be responsible for ensuring compliance with all Terms and program requirements.

Registration Process: To participate in our programs or access certain features of our Website, you may be required to create an account and provide accurate, current, and complete information. You agree to maintain and promptly update your account information to ensure it remains accurate and complete. Registration information may include but is not limited to participant name, date of birth, contact information, emergency contacts, medical information, skiing/snowboarding experience level, and payment information.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Team Summit of any unauthorized use of your account or any other breach of security. Team Summit will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Parental Responsibility: Parents and legal guardians who create accounts for minor participants acknowledge that they are fully responsible for all activities conducted through such accounts, including but not limited to program registration, payment obligations, compliance with program rules, and adherence to these Terms. Parents and guardians agree to supervise their minor children’s use of our Services and Website.

Accuracy of Information: You represent and warrant that all information provided during registration and throughout your use of our Services is accurate, current, and complete. Providing false, misleading, or incomplete information may result in immediate termination of your account and exclusion from programs. You acknowledge that Team Summit relies on the accuracy of this information for safety, communication, and program administration purposes.

Account Termination: Team Summit reserves the right to suspend or terminate accounts at any time for any reason, including but not limited to violation of these Terms, inappropriate conduct, non-payment of fees, or providing false information. Upon termination, your right to use the Services will cease immediately, though certain provisions of these Terms will survive termination as specified herein.

4. Program Registration and Participation

Registration Requirements: Participation in Team Summit programs requires completion of our registration process, which includes submission of required forms, medical information, emergency contacts, and payment of applicable fees. Registration is not complete until all requirements are satisfied and payment is received. Team Summit reserves the right to reject any registration application at its sole discretion.

Program Capacity: Many of our programs have limited capacity, and registration is typically processed on a first-come, first-served basis among qualified applicants. Team Summit does not guarantee availability in any specific program and reserves the right to establish waiting lists, transfer participants between programs, or cancel programs due to insufficient enrollment or other circumstances beyond our control.

Medical Requirements: All participants must provide current medical information, including but not limited to emergency contacts, medical conditions, medications, allergies, and physician contact information. Participants may be required to provide additional medical documentation, including physical examinations or medical clearances, as determined by Team Summit. Failure to provide accurate and complete medical information may result in exclusion from programs.

Equipment and Safety: Participants are responsible for providing appropriate equipment for their chosen programs, including but not limited to skis, snowboards, boots, helmets, and protective gear. All equipment must meet safety standards established by Team Summit and relevant governing bodies. Team Summit reserves the right to inspect equipment and exclude participants whose equipment does not meet safety requirements.

Code of Conduct: All participants, parents, and family members are expected to conduct themselves in accordance with Team Summit’s core values of excellence, respect, integrity, responsibility, fun, and family. This includes respectful treatment of coaches, staff, volunteers, other participants, and facility personnel, as well as compliance with all program rules and venue regulations. Violations of our code of conduct may result in immediate removal from programs without refund.

SafeSport Compliance: Team Summit is committed to providing a safe environment for all participants. We comply with U.S. Center for SafeSport policies and procedures, and all coaches participate in annual SafeSport training. Participants and families are expected to report any concerns regarding inappropriate conduct through proper channels as outlined in our SafeSport policies.

5. Payment Terms and Refund Policy

Program Fees: Participation in Team Summit programs requires payment of applicable fees as specified in program descriptions and registration materials. Fees may include but are not limited to program tuition, equipment costs, travel expenses, competition fees, and administrative charges. All fees are due according to the payment schedule established for each program, and late payments may result in exclusion from activities or additional charges.

Payment Methods: Team Summit accepts various forms of payment as specified during the registration process, including credit cards, electronic transfers, and checks. All payments are processed through secure third-party payment processors, and you agree to comply with the terms and conditions of such processors. Team Summit is not responsible for any fees charged by your financial institution in connection with payments.

Refund Policy: Refunds are governed by the specific terms established for each program and are generally limited to circumstances beyond the participant’s control. Refund requests must be submitted in writing and will be evaluated on a case-by-case basis. Administrative fees may be deducted from any approved refunds. No refunds will be provided for voluntary withdrawal from programs after the specified deadline, disciplinary removals, or failure to participate due to injury or illness unless covered by applicable insurance.

Financial Assistance: Team Summit offers a Financial Assistance Program to help make our programs accessible to families with demonstrated financial need. Information about financial assistance is available through our office, and applications are evaluated confidentially according to established criteria. Financial assistance does not alter the participant’s obligations under these Terms.

Fundraising and Donations: Donations to Team Summit are processed through our Website and are subject to our donation policies. All donations are voluntary and, unless otherwise specified, are non-refundable. Donors will receive appropriate acknowledgment and tax documentation as required by law. Team Summit reserves the right to use donations for general organizational purposes unless specifically designated for particular programs or purposes.

6. Assumption of Risk and Release of Liability

Inherent Risks: Participation in skiing, snowboarding, mountain biking, and related activities involves inherent and significant risks of property damage, serious bodily injury, and death. These risks include but are not limited to collisions with natural or artificial objects, other participants, or equipment; falls; avalanches; changing weather and snow conditions; equipment failure; and the negligence of other participants. You acknowledge that these risks cannot be eliminated regardless of the care taken to avoid injuries.

Voluntary Participation: Participation in Team Summit programs is entirely voluntary. By registering for and participating in our programs, you acknowledge that you have carefully considered these risks and voluntarily choose to participate despite these risks. You understand that Team Summit cannot guarantee your safety and that you participate at your own risk.

Release of Claims: To the fullest extent permitted by law, you, on behalf of yourself and your minor children, hereby release, waive, discharge, and covenant not to sue Team Summit Colorado, its directors, officers, employees, coaches, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained while participating in Team Summit programs or activities, or while on the premises of any venue used for Team Summit activities.

Indemnification: You agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur arising out of or related to your participation in Team Summit programs, whether caused by the negligence of the Released Parties or otherwise. This indemnification includes but is not limited to attorney’s fees and costs.

Medical Treatment Authorization: You authorize Team Summit staff to secure emergency medical treatment for you or your minor child if necessary, and you agree to be financially responsible for any costs incurred. You acknowledge that Team Summit does not provide medical insurance coverage for participants and recommend that you maintain adequate health insurance coverage.

Limitation of Liability: In no event shall Team Summit’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you to Team Summit for the specific program or service giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based.

7. Intellectual Property Rights

Team Summit Property: The Website and Services, including all content, features, functionality, information, software, text, displays, images, video, audio, design, selection, arrangement, and overall appearance, are owned by Team Summit Colorado, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Trademarks: The Team Summit Colorado name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Team Summit Colorado or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Website are the trademarks of their respective owners.

Limited License: Subject to your compliance with these Terms, Team Summit grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Website and Services solely for your personal, non-commercial use in connection with Team Summit programs and activities. This license does not include any right to resell or make commercial use of the Website or Services, collect and use product listings or descriptions, make derivative use of the Website or Services, download or copy account information, or use data mining or similar data gathering tools.

User-Generated Content: Our Website may allow you to submit, upload, publish, or otherwise make available content such as comments, reviews, photos, videos, or testimonials (“User Content”). You retain ownership of any intellectual property rights that you hold in your User Content, but you grant Team Summit a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with our Services and business operations.

Content Standards: All User Content must comply with our content standards and may not contain material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable. User Content must not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age, and must not infringe any patent, trademark, trade secret, copyright, or other intellectual property rights of any party.

Content Monitoring: Team Summit has the right but not the obligation to monitor, review, and remove User Content that violates these Terms or is otherwise objectionable. We reserve the right to remove or disable access to any User Content at any time without notice and for any reason, including if we believe it violates these Terms.

8. Website Usage and Prohibited Conduct

Permitted Use: You may use our Website and Services only for lawful purposes and in accordance with these Terms. You agree not to use the Website or Services in any way that violates any applicable federal, state, local, or international law or regulation, or in any manner that could damage, disable, overburden, or impair our servers or networks.

Prohibited Activities: You agree not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the Website in any medium; (b) using any automated system to access the Website; (c) transmitting spam, chain letters, or other unsolicited email; (d) attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from our servers; (e) taking any action that imposes an unreasonable load on our infrastructure; (f) uploading invalid data, viruses, worms, or other software agents; (g) collecting or harvesting any personally identifiable information from the Website; (h) using the Website for any commercial solicitation purposes; (i) impersonating another person or misrepresenting your affiliation with a person or organization.

Account Misuse: You may not use another user’s account without permission, create false accounts, or provide false information during registration. You may not attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website through hacking, password mining, or any other means.

Compliance with Venue Rules: When participating in Team Summit activities at ski areas, training facilities, or other venues, you agree to comply with all rules, regulations, and policies of such venues. Violations of venue rules may result in removal from the premises and exclusion from Team Summit programs.

Reporting Violations: If you become aware of any violations of these Terms or inappropriate conduct by other users, you agree to report such violations to Team Summit promptly. We rely on our community to help maintain a safe and positive environment for all participants.

9. Privacy and Data Protection

Privacy Policy Integration: Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Website and Services, you consent to the collection and use of your information as described in our Privacy Policy.

Data Security: While we implement reasonable security measures to protect your personal information, you acknowledge that no method of transmission over the internet or electronic storage is completely secure. You provide information at your own risk, and Team Summit cannot guarantee the absolute security of your data.

Communications: By registering for our Services, you consent to receive communications from Team Summit via email, text message, phone, or other electronic means. These communications may include program updates, safety information, promotional materials, and administrative notices. You may opt out of promotional communications but cannot opt out of essential program-related communications.

10. Third-Party Services and Links

Third-Party Integration: Our Website and Services may integrate with or contain links to third-party websites, applications, or services, including payment processors, email marketing providers, and social media platforms. These third-party services are governed by their own terms of service and privacy policies, and Team Summit is not responsible for their content, policies, or practices.

Payment Processing: Financial transactions are processed through third-party payment processors that maintain their own terms of service and privacy policies. You agree to comply with such terms when making payments through our Website. Team Summit is not responsible for any issues arising from the use of third-party payment processors.

External Venues: Team Summit programs often take place at ski areas and other facilities owned and operated by third parties. Your use of such facilities is subject to their respective terms, conditions, and liability policies in addition to these Terms. Team Summit is not responsible for the condition, safety, or policies of third-party venues.

11. Dispute Resolution and Governing Law

Governing Law: These Terms and any disputes arising out of or related to these Terms or your use of our Website and Services shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.

Jurisdiction: Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Summit County, Colorado, and you hereby consent to personal jurisdiction and venue therein.

Limitation of Actions: Any claim or cause of action arising out of or related to your use of the Website or Services must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.

Dispute Resolution: Before filing any legal action, you agree to first contact Team Summit to attempt to resolve any disputes informally. We are committed to working with our community members to resolve issues fairly and efficiently.

12. Modifications and Termination

Modification of Terms: Team Summit reserves the right to modify these Terms at any time by posting revised Terms on our Website. Your continued use of the Website or Services following such posting constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of our Website and Services.

Modification of Services: Team Summit reserves the right to modify, suspend, or discontinue any aspect of our Website or Services at any time without notice. We may also impose limits on certain features or restrict access to parts or all of the Website or Services without notice or liability.

Termination: Either party may terminate your access to the Website and Services at any time. Team Summit may terminate your access immediately without notice if you violate these Terms. Upon termination, your right to use the Website and Services will cease immediately, but the provisions of these Terms that by their nature should survive termination will remain in effect.

13. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any additional terms applicable to specific programs or services, constitute the entire agreement between you and Team Summit regarding your use of our Website and Services and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Assignment: You may not assign or transfer these Terms or your rights hereunder without Team Summit’s prior written consent. Team Summit may assign these Terms without restriction.

Waiver: No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term, and Team Summit’s failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.

Force Majeure: Team Summit will not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, weather conditions, government actions, or other force majeure events.
